The Commission may take a decision pursuant to paragraphs 1 to 3 without being bound by the time limits referred to in Article 10(3), in cases where: it finds that a concentration has been implemented in contravention of a condition attached to a decision under Article 6(1)(b), or (ii) in contravention of a condition attached to a decision taken under paragraph 2 and in accordance with Article 10(2), which has found that, in the absence of the condition, the concentration would raise serious doubts as to its compatibility with the common market; or a decision has been revoked pursuant to paragraph 6.
