Die einschlägige Verwaltungsbehörde trifft die Feststellung nach Artikel 2 Absatz 1 Nummer 8 Buchstabe a so rasch wie möglich, spätestens aber fünf Arbeitstage nachdem sie erstmals festgestellt haben, dass ein Kreditinstitut die fälligen und rückzahlbaren Einlagen nicht zurückgezahlt hat.
