9. In respect of proceedings pursuant to paragraph 2, the Commission may, upon request or on its own initiative, decide to reopen them where: there has been a material change in any of the facts on which the decision was based; or the decision was based on incomplete, incorrect or misleading information; or the measures as specified in the decision are not effective.
