Article 35 is amended as follows: paragraph 2 is replaced by the following: ‘2. Paragraph 1 shall not apply to payment systems composed exclusively of payment service providers belonging to a group.’ ; the following paragraph is added: ‘3. Member States shall ensure that where a participant in a payment system designated under Directive 98/26/EC of the European Parliament and of the Council (*5) allows an authorised or registered payment service provider that is not a participant in the system to pass transfer orders through the system that participant shall, when requested, give the same opportunity in an objective, proportionate and non-discriminatory manner to other authorised or registered payment service providers in line with paragraph 1 of this Article. The participant shall provide the requesting payment service provider with full reasons for any rejection. (*5) Directive 98/26/EC of the European Parliament and of the Council of 19 May 1998 on settlement finality in payment and securities settlement systems (OJ L 166, 11.6.1998, p. 45).’;"
