| 33. | Risk mitigation measures, taken in line with Article 35 of Regulation (EU) 2022/2065, should be taken with due regard for the protection of fundamental rights enshrined in the Charter of Fundamental Rights of the European Union, in particular the right to freedom of expression and of information, including media freedom and pluralism. In line with Recital 47 of that Regulation, providers of VLOPs and VLOSEs should pay due regard to relevant international human rights standards such as the United Nations Guiding Principles on Business and Human Rights (UNGPs). Relevant independent reports (29) may also be considered when designing and enforcing mitigation measures.
